Before entering the Comes with Music Contest, please read and indicate that you accept the Of-ficial Rules and Regulations, the Privacy Policy and the Site Terms. If you do not accept them, you are not eligible to participate in the Contest

ELIGIBILITY

Comes with Music Competition (hereinafter referred to as “the Contest”), brought to you by The Nokia Corporation, Espoo, Finland, (hereinafter referred to as the “Sponsor”) will be governed by these rules (the “Official Rules”). The Contest is open to participants/contestants (hereinafter referred to as “Par-ticipants”) in all participating countries who have compatible computer hardware and software.  Please see the list at the end of this for system requirements.

The Sponsor, its subsidiaries, affiliates and agents reserve the right at any time to verify that any and all Participants meet the eligibility requirements in any manner deemed appropriate. The employees and directors of the Sponsor and/or its licensees, advertising, promotion or production agencies and provider companies (and their respective IRS dependents, immediate family members (spouse, chil-dren, parents, siblings) and individuals residing in their same household) are not eligible to partici-pate. Participants must agree to these Official Rules and the decisions of the judges, which are final and binding in all matters relating to this Contest.
The Contest is void wherever prohibited or restricted by any mandatory national, state or other gov-ernment laws in form and language as provided herein and is subject to all applicable mandatory fed-eral (national), state and local laws.

PROGRAM PERIOD

The Contest begins on 01.10.2009 at and ends when the 01.10.2010 (hereinafter referred to as the “Program Period”).

HOW TO PARTICIPATE

The Nokia community manager or other Nokia representative manager will post a request for submis-sions of top albums by music genre on various social networks, groups, communities, blogs and fo-rums. The topics or genres will be chosen at the sole discretion of the Nokia music representative and will only be subject to change from the aforementioned Nokia music representative.   To participate in the competition simply submit your choices for your favorite songs and or albums in the relevant cate-gories.   A top list of albums by genre will be created from these submissions and published on the Nokia Music Store.

CONTEST MECHANICS

In order to access the Site, you must have access to the World Wide Web (Internet) provided by an Internet Service Provider (hereinafter referred to as an “ISP”) of your choosing and you must pay any applicable ISP, operator, service and other fees for such access. Any registration that, in the sole dis-cretion of the Sponsor, is considered inappropriate or unsuitable for publication will be deemed ineli-gible by the Sponsor. The Sponsor reserves the right to invalidate all registrations in any manner it deems appropriate. Registrations that are found to be irregular (as solely determined by the Sponsor) will cause those registrations to be deemed void and the Participant to be disqualified.

THE INFORMATION SUBMITTED BY YOU

The information submitted by you will only be used by the Sponsor, in accordance with the applicable data protection regulations and the Privacy Policy of the Site, for the purposes of administrating your participation in the Contest. The information collected will be deleted and destroyed after the end of the Program Period. The Sponsor will not transfer or disclose the information submitted by you to any third parties.
By participating in the Contest and submitting your name, address, city and country of residence, mo-bile phone number and e-mail address (hereinafter referred to as “Personal Information”) you are acknowledging that you fully accept and give your unambiguous consent that the Personal Information collected in connection with your use of the Site and participation in the Contest may be transferred across international borders to server locations supporting the Site. (Including but not limited to transfers from those locations back to the country of your registration) for the purposes of adminis-trating your participation in the Contest and storing the Personal Information submitted by you in the relevant database during the Program Period.

You have the right at any time during the Program Period to review, correct or remove the Personal Information submitted by you following the guidelines provided in the Site’s Privacy Policy.

PRIZES

The winner/winners of the Contest will receive either

a) limited number of non-transferable, non-refundable OVI music downloads. (This prize is available only to UK residents).

b) Nokia 5800 handset + ‘Comes With Music’ subscription. (this prize is available to residents of Australia, Austria, Brazil, Germany, Mexico, Netherlands, Italy, Singapore, Spain, Switzerland, Sweden and the UK only)

c) Nokia X6 handset + ‘Comes With Music’ subscription. (this prize is available to residents of Finland, Russia, South Africa, Sweden, Italy, UK, Switzerland, Singapore, Netherlands, China and Malaysia only).

Prize allocation is at the discretion of the individual blog owners and Nokia.

The Prizes cannot be assigned, transferred, redeemed for cash, or substituted except by the Sponsor, who may, at its sole discretion, substitute any Prize with one of comparable value if the advertised Prize becomes unavailable for any reason.

DETERMINATION OF THE WINNER

The winner/winners of the Contest will be determined by Nokia and chosen at random from all submissions that make the top list of albums.
Where possible winners will be notified by email, or alternatively through the relevant forum, notice board or discussion group. An email notifying the winner of his/her Prize will include a request to con-firm his/her preferred mailing address. The winner must respond with his/her preferred mailing ad-dress within 1 week failing which the winner shall forfeit the Prize. In the event of such forfeiture, the Sponsor shall select another winner based on the selection criteria above or dispose of the Prize in any way it deems fit. The winner may redeem their prize online at the relevant OVI music website or the prize shall be delivered to the address provided by the winner. The Sponsor shall not be liable for any loss or damage whatsoever which is suffered (including but not limited to indirect or consequential loss) in the delivery of the Prize to the winner.

GENERAL RULES

Participation constitutes consent (a) to comply with these Official Rules, the Site’s Site Terms and Pri-vacy Policy, and (b) that the Participant release and hold harmless the Sponsor, its subsidiaries, affili-ates, advertising and promotion agencies, and all of their respective officers, directors, employees, representatives and agents from any and all liability or any injuries, including death, loss or damage of any kind arising in whole or in part, directly or indirectly, from acceptance, possession, misuse or use of any Prize or participation in the Contest or any Contest-related activities. If a winner is found to be ineligible or not in compliance with these Official Rules, the winner’s Prize will be forfeited and an alternate winner selected.

MISCELLANEOUS

These Official Rules are governed by the laws of Finland.
To the maximum extent permitted by applicable law, the Sponsor reserves the right at its sole discre-tion to amend, withdraw or revise these Official Rules and the Prizes at any time without notice and in such event the Sponsor shall not have any liability whatsoever.
You acknowledge and agree that you must conduct yourself in a mature and decent manner to other Participants, chat room spectators, and the Sponsor. You acknowledge and agree that the Sponsor is permitted to automatically disqualify any Participant that is acting in an unreasonable manner (to be determined in the sole and absolute discretion of the Sponsor on a case by case basis).
You acknowledge and agree that no form of cheating will be tolerated. Any persons found cheating, as determined in the sole and absolute discretion of the Sponsor, will immediately be disqualified from the Contest. Cheating includes but is not limited to tampering, hacking of website, playing the Contest without meeting the eligibility requirements, using any automated software or device to gain an ad-vantage during the Contest, using any cheat codes, exploiting any software bugs, use of the Contest beyond the defined rules of the Contest, attempting to disable or overwhelm any of the Sponsor sites, attempts to disrupt any portion of the Contest, including but not limited to allowing somebody else to use your Personal Information tampering with entry process or operation of promotion or website.

CAUTION: ANY ATTEMPT BY A PERSON TO DELIBERATELY DAMAGE ANY OF THE SPONSOR SITES OR UNDERMINE THE LEGITIMATE OPERATION OF THE CONTEST MAY BE A VIOLATION OF CRIMINAL AND CIVIL LAWS; AND SHOULD SUCH AN ATTEMPT BE MADE, THE SPONSOR RE-SERVES THE RIGHT TO SEEK DAMAGES FROM ANY SUCH PERSON TO THE FULLEST EXTENT PERMITTED BY LAW.

You acknowledge and agree that all disputes in relation to the Contest, including but not limited to scoring, placing, eligibility, cheating, advancement and any other issue related to the Contest shall be determined in the sole and absolute discretion of the Sponsor, and that such a decision by the site op-erators or event officials shall be final and binding.
You agree not to use the Site to “stalk” or harass another person and your Content and use will not suggest or encourage to any illegal activity;
Furthermore, your use of the Site will not compromise the security or integrity of the Sponsor’s com-puter systems, networks or web site(s) or servers, whether by allowing intruders into the same, intro-ducing viruses or other threats, imposing a disproportionate or unreasonably large load on this Site or its infrastructure, or using any computer programming routine, file or device to damage or interfere with the operation of the Site;
You will not post, publish, transmit, distribute, or upload through the Site(s) or Contest any unauthor-ized or unsolicited bulk e-mail solicitations, chain letters, advertisements, marketing or promotional materials, “junk mail”, “spam”, pyramid schemes or any other solicitations or communications, includ-ing without limitation spamming the Sponsor or other users of the Site(s), or use or collect other users e-mail addresses or phone numbers, or other users information or postings, or use the Site to perform any data collection, extraction or mining or gain or attempt to gain unauthorized access to Sponsor or any site visitor’s computer system.
You will not register with or otherwise use a false name, identity or e-mail address, impersonate any person or entity, including without limitation the Sponsor or its licensors’ personnel, falsely state or otherwise misrepresent your affiliation with a person or entity, use another user’s password (if appli-cable), forge headers or otherwise manipulate identification information to falsify or disguise the ori-gin of any Content, or falsify or misrepresent any Content with respect to submissions to the Site, and You will follow all applicable laws and regulations applicable to your use of the Site. Such laws and regulations include, without limitation, those governing copyright, defamation, privacy, publicity and the access or use of others’ computer or communication systems.
